چکیده
عدم مسئولیت ورزشکاران از موضوعات مهم حقوق ورزش است که به دلیل خلاء قانونی در این خصوص نیازمند بحث و بررسی است. بر همین اساس هدف مقاله حاضر بررسی این سوال مهم است که شرایط عدم مسئولیت مدنی ورزشکاران در فقه و حقوق چیست؟ این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانهای به بررسی سوال مورد اشاره پرداخته است. در حقوق موضوعه، رضایت آگاهانه، تقصیر زیاندیده، هشدار، اقدام ورزشکار در قالب قانون و عرف ورزش و رعایت مقررات ورزشی، قبول خطر و اسقاط حق از مهمترین شرایط عدم مسئولیت مدنی ورزشکاران است که برگرفته از قاعده اقدام، قاعده اذن و قاعده تحذیر در فقه می باشد. عرف حاکم بر جوامع ورزشی حاکی از آن است که چنانچه حادثهای در خلال عملیات ورزشی که قانونی و باتوجه به مقرّرات انجام میشده، رخ دهد، اصل بر عدم مسئولیت برای ورزشکاران میباشد و تا زمانی که سوءنیت ورزشکاری در رابطه با ورود ضرر و آسیب به حریف اثبات نگردد و تا زمانی که تخلف روشن و عمدهای از سوی بازیکنان صورت نگیرد، عرف جوامع ورزشی حکم به محکومیت ورزشکاران صادر نمیکند. در اکثر ورزشهای متداول برخورد و ایراد صدمه غیر قابل اجتناب است. اگر ورزشکاری ناخواسته و بدون سوءنیت و با رعایت قوانین و مراقبتهای لازم با زدن ضربه به صورت متعارف در عملیات ورزشی باعث ایراد صدمه به طرف مقابل شد، معاف از مسئولیت مدنی میباشد و نتیجتاً اینکه خطر، لازمه حرکتهای ورزشی است و اجرای قواعد عمومی مسئولیت مدنی دربارهی آنها ممکن نیست.
